FORESCOUT EXPORT COMPLIANCE<\/h1>\n

Overview<\/strong><\/h2>\n

Forescout and its Business Partners are committed to fully complying with the United States and all applicable export and import laws and regulations in the jurisdictions in which we operate.<\/p>\n

Product Export Classification and Licensing Definitions<\/strong><\/h2>\n

Following are definitions of key terms that relate to the export classification and licensing of Forescout products and technology. If you have a question about how a Forescout product has been classified for export, please refer to the\u00a0Forescout Trade Compliance Product Classification Guide<\/a>\u00a0or contact our Export Compliance team at\u00a0export@forescout.com<\/a>.<\/p>\n

BIS:<\/strong>\u00a0Bureau of Industry and Security<\/p>\n

CCATS:<\/strong>\u00a0Refers to the Commodity Classification Automated Tracking System, or CCATS, number that BIS assigns to a commodity classification request.<\/p>\n

Deemed Export:<\/strong>\u00a0Under the EAR, an export is \u201cdeemed\u201d to take place when technology or source code is released to a foreign national in the United States. Such a release is viewed as an export to that foreign national\u2019s country or last country of permanent residence.<\/p>\n

EAR:<\/strong>\u00a0Export Administration Regulations<\/p>\n

EAR99<\/strong>: Refers to items that are subject to the EAR but are not listed on the CCL.<\/p>\n

ECCN:<\/strong>\u00a0The Export Control Classification Number, or ECCN, is the U.S. term for an export classification code. An ECCN identifies the relevant category and paragraph of a classification, as they are maintained under the EAR\u2019s Commerce Control List or CCL.<\/p>\n

Typically, Forescout\u2019s products are classified under EAR99.<\/p>\n

NLR:<\/strong>\u00a0No export license required.<\/p>\n

Export Regulations and Department of Commerce Controls<\/strong><\/h2>\n

Exports, re-exports and transfers of Forescout products, hardware, software, service, support, and technology are subject to control under the\u00a0Export Administration Regulations<\/u><\/a>\u00a0(\u201cEAR<\/strong>\u201d), as administered by the U.S. Department of Commerce\u2019s\u00a0Bureau of Industry and Security<\/u><\/a>\u00a0(\u201cBIS<\/strong>\u201c), and imports are subject to control under U.S. Customs and Border Protection regulations. Diversion of Forescout products and technology contrary to U.S. law is prohibited. Depending on where you reside, or the jurisdictions in which you operate, additional import or export regulations may apply.<\/p>\n

Department of Treasury Controls<\/strong><\/h2>\n

The export or re-export of items, that are subject to the EAR, to an embargoed or sanctioned destination (Cuba, Iran, North Korea, Sudan, and Syria) without a valid license or license exception is prohibited. Further, the U.S. Department of Treasury\u2019s\u00a0Office of Foreign Assets Control<\/u><\/a>\u00a0may impose additional controls on exports, re-exports, or transfers to these destinations.<\/p>\n

Exports to entities listed on a U.S. government denied party\/prohibited end-user list may be prohibited or proceed only if they have been licensed. Further information on these lists may be found\u00a0here<\/u><\/a>. In addition, exports that support the design, development, or production of biological, chemical, or nuclear weapons, or missile proliferation, are prohibited without prior U.S. government authorization.<\/p>\n
